These Terms & Conditions apply to purchases made from Akira Jewellery Inc. ("Akira Jewellery", "Akira", "we", "us" or "our"), including purchases made in-store, online, by telephone, by electronic communication, and through other remote ordering methods, where applicable.
By purchasing goods from Akira Jewellery, the customer ("customer", "consumer", "you" or "your") agrees to the applicable terms below.
These Terms & Conditions are intended to explain our sales practices, customer policies and the rights and obligations associated with purchases from Akira Jewellery.

Akira Jewellery sells gold jewellery, diamond jewellery, silver products and related jewellery products, including regular, custom, engraved, personalized, resized and special-order products.
2. Application of Consumer Protection Law
Akira Jewellery complies with applicable Ontario consumer protection legislation.
Nothing in these Terms & Conditions is intended to exclude, restrict, waive or limit any right, remedy, warranty, cancellation right, disclosure requirement or other protection available to a consumer under the Ontario Consumer Protection Act, 2002, its regulations, or any other applicable law.
If any provision conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will prevail. No customer is required to waive a statutory right as a condition of purchasing goods.
3. Products and Product Descriptions
We make reasonable efforts to ensure that product descriptions, photographs, prices, measurements, weights, metal specifications, gemstone information and other product information are accurate.
- Photographs may vary slightly due to lighting, photography and display-screen differences.
- Measurements and weights may have reasonable manufacturing tolerances.
- Jewellery may have minor manufacturing and finishing variations.
- Natural gemstones may vary in colour, clarity, inclusions and appearance.
- Product availability may change without notice.
Where a specific characteristic is material to the purchase, the applicable invoice, product description or written order confirmation will govern.
4. Gold, Silver, Diamonds and Precious Gemstones
Where a product is represented as 22K gold, 916 gold, sterling silver, diamond or another specific precious-metal or gemstone product, the applicable product description and/or invoice will identify the relevant material or specification. Where applicable, hallmarking, certification or other documentation may be provided. Customers should review the product description and invoice and ask staff any questions before approving an order.
5. Prices, Taxes and Market Fluctuations
All prices are in Canadian dollars unless expressly stated otherwise. Applicable taxes, including HST where applicable, will be charged in accordance with law. Precious-metal and gemstone prices may change before a purchase is completed. A displayed price does not necessarily constitute a completed sale until the order has been accepted and payment or financing arrangements completed.
Once a purchase is completed, Akira Jewellery does not provide a price adjustment, refund or credit solely because a market price subsequently changes.
6. Orders and Order Acceptance
Submitting an order, requesting a custom item, placing a deposit or providing payment does not necessarily mean that Akira Jewellery has accepted the order. We may confirm product availability, specifications, pricing, payment, shipping, custom-order details, identification or other information reasonably necessary to complete the transaction. If we cannot fulfill an order, we will communicate with the customer and, where applicable and legally required, refund amounts paid for goods we cannot supply.
7. Customer Review and Order Correction
For online and other remote purchases, customers are responsible for reviewing the order before completing it, including the product, quantity, price, ring size, chain length, engraving, personalization, photographs or artwork, shipping address, billing information and other specifications.
For internet agreements to which the Ontario Consumer Protection Act applies, Akira Jewellery will provide the required information and an opportunity to accept or decline the agreement and correct errors immediately before entering into it.
8. Returns, Exchanges and Final Sale Policy
Due to the nature of jewellery and precious-metal and gemstone markets, all sales are final unless an exchange is expressly permitted or a consumer has a right or remedy that cannot legally be excluded.
8.1 Voluntary Exchange Policy
Eligible exchanges may be requested within 3 calendar days of delivery. The item must be unworn, unused, undamaged, in original condition, accompanied by the original invoice, include original packaging, tags and documentation where applicable, and pass inspection.
8.2 No Cash Refund for Voluntary Exchanges
No cash refund will be provided for an approved voluntary exchange. The replacement item must be of equal or greater value; any difference must be paid before completion.
8.3 Custom and Personalized Jewellery
Custom-made, engraved, personalized, special-order and resized items are final sale once production, customization or resizing has commenced, except where a consumer has a non-excludable legal right or remedy. This includes custom photo pendants, customer-specified designs, altered or resized jewellery and items manufactured or modified specifically for the customer.
8.4 Clearance and Final-Sale Products
Products identified as Clearance, Final Sale or otherwise designated as final sale are not eligible for voluntary return or exchange, except where required by law.
8.5 Statutory Rights
These voluntary exchange and final-sale policies do not remove, restrict or waive any statutory right or remedy under Ontario law.
9. Defective, Incorrect or Non-Conforming Products
If an item is defective, materially different from the product ordered, does not match agreed specifications, is missing an agreed component or otherwise does not conform to the agreement, contact Akira Jewellery promptly with the order or invoice information. We will assess the matter and provide any remedy required by applicable law.
10. Shipping Damage
Report shipping damage as soon as reasonably possible after delivery, preferably within 48 hours. Provide photographs of the package, shipping label, external and internal packaging and damaged item, and retain all materials until resolved. The 48-hour period is an administrative request and does not limit any non-excludable legal right or remedy.
11. Custom Orders and Customer Specifications
Customers are responsible for confirming ring or bracelet size, chain length, pendant dimensions, design, engraving, spelling, dates, names, initials, photographs, personalization, gemstone and metal selection and other specifications before approving a custom order. Once production starts, changes may not be possible and requested changes may involve additional charges. Akira Jewellery is not responsible for customer-approved specifications where the product was produced accordingly, subject to applicable law.
12. Custom Photo and Engraving Orders
Customers must have the right to use photographs, text and other materials supplied for personalized products. They are responsible for clear photographs, correct spelling and dates, and complete design instructions. Personalized products are final sale once production or customization commences, except where required by law.
13. Ring Sizing and Resizing
Customers are responsible for confirming ring size. Resizing may be subject to availability, technical limitations, fees, changes to appearance or structure and turnaround times. A resized item is altered/customized and generally final sale, except where required by law.
14. Repairs and Alterations
Repairs, resizing, polishing, modifications and alterations may be subject to inspection, availability, fees and turnaround times. Akira Jewellery is not responsible for damage resulting from normal wear and tear, accidental damage, misuse, improper handling or storage, unauthorized repairs, chemicals, failure to follow care instructions or circumstances outside its control. This does not exclude any non-excludable warranty or legal right.
15. Delivery and Shipping
Customers are responsible for accurate delivery information. Estimated delivery dates are estimates unless a specific date is agreed in writing. Delivery may be affected by carrier delays, weather, customs, labour disruptions, security requirements or other unforeseen events. Applicable shipping charges, insurance and delivery methods will be disclosed before completion.
16. Pick-Up Orders
Customers should collect pickup orders within the communicated period and may be required to provide identification or proof of purchase. Akira Jewellery may contact customers regarding extended uncollected orders. Legal rights relating to cancellation, deposits, unclaimed goods or consumer agreements remain unaffected.
17. Payment
Payment must be successfully completed before an order is released unless otherwise agreed in writing. Akira Jewellery may decline or delay a transaction to verify payment, prevent fraud, comply with legal requirements or confirm identity.
18. Financing and Affirm
Third-party financing, including Affirm, is a separate agreement subject to the provider's terms. The jewellery purchase remains subject to Akira Jewellery's policies and applicable law. Akira Jewellery does not control approval decisions, rates, schedules or account administration. Where a legal right or remedy concerns the underlying purchase, Akira Jewellery will handle it in accordance with applicable law and transaction terms.
19. Deposits and Partial Payments
The invoice or written agreement will identify deposits or partial payments, the balance owing and, where applicable, completion or delivery arrangements. A deposit does not automatically create a cancellation or refund right. Custom, personalized and special-order terms apply, subject to applicable law.
20. Trade-Ins
Any written invoice or agreement will identify a trade-in arrangement and credited value. Terms may vary based on product, condition, metal content, weight, market conditions and other factors.
21. Price Changes and Market Conditions
Prices may change due to market conditions, supplier costs, currency fluctuations and other commercial factors. Prices are not guaranteed until purchase completion. Subsequent market changes do not create a right to adjustment, refund or credit solely because a market price changes. This does not affect statutory rights or remedies.
22. Product Care and Normal Wear
Jewellery requires reasonable care. Customers should follow care instructions and avoid substances, chemicals, activities or conditions that may cause damage. Normal wear and tear is not a manufacturing defect and may include scratches, surface wear, loss of polish, minor dents, impact damage, bent or broken components, chemical damage and improper-storage damage. This does not exclude any applicable warranty or statutory remedy.
23. Online and Internet Agreements
For internet agreements governed by the Ontario Consumer Protection Act, Akira Jewellery will provide required information before the consumer enters the agreement, including business and contact information, goods, price and taxes, additional charges, payment, delivery, restrictions, applicable policies and cancellation rights. Customers will have an opportunity to review, correct errors and accept or decline the agreement, and will receive a retainable copy where required.
24. Cancellation Rights Required by Law
Voluntary return and exchange policies do not replace statutory cancellation rights. Certain agreements may be cancelled where prescribed by the Ontario Consumer Protection Act and regulations, including where required information or copies were not provided. A statutory right applies notwithstanding a final-sale or no-return provision.
25. Future-Performance and Prepaid Orders
Where statutory requirements apply to future-performance agreements, Akira Jewellery will comply with requirements concerning written agreements, disclosure, delivery or performance dates and cancellation rights. A legally prescribed cancellation right cannot be waived.
26. Customer Communications
Customers may contact Akira Jewellery about orders, returns, exchanges, warranty concerns, delivery issues or other transaction matters using the contact information below. Include the invoice or order number and sufficient information to identify the transaction.
27. Complaint Resolution
Customers are encouraged to contact us directly so we can review and attempt to resolve concerns.

If a customer believes a statutory consumer right has been violated, they may also contact the appropriate Ontario government consumer-protection authority. Nothing prevents a consumer from exercising any right or remedy available under law.
28. Privacy
Personal information collected by Akira Jewellery is handled in accordance with our Privacy Policy, which customers should review for information about collection, use, disclosure and protection.
29. Electronic Communications and CASL
Where applicable, commercial electronic messages are sent in accordance with Canada's Anti-Spam Legislation (CASL). Customers may unsubscribe using the mechanism in the message or by contacting Akira Jewellery. Transactional or service-related communications may continue where permitted by law.
30. Website Use
The website may contain product information, photographs, descriptions, articles, graphics, logos and other content. Customers may use it for lawful personal and purchasing purposes and must not misuse it, interfere with operation, scrape data without authorization, introduce malicious code, use it fraudulently or infringe intellectual-property rights.
31. Intellectual Property
Unless otherwise stated, Akira Jewellery owns or has permission to use the trademarks, logos, photographs, graphics, written material and other intellectual property displayed on the website. No permission is granted to reproduce, distribute, modify, sell or commercially exploit it without authorization.
32. Customer-Submitted Content
Customers submitting photographs, designs, text or other material for a custom order represent that they have the necessary rights or permission. Akira Jewellery may use those materials only as reasonably necessary to fulfill the order and provide related services, subject to its Privacy Policy and applicable law. We do not claim ownership of the customer's underlying materials merely because they are provided to us.
33. Limitation of Liability
To the maximum extent permitted by law, Akira Jewellery will not be responsible for indirect, incidental or consequential losses arising from website use or circumstances outside its reasonable control. Nothing excludes or limits liability, statutory rights, statutory warranties or remedies where prohibited by law or prevents a consumer from exercising an available right or remedy.
34. No Waiver of Consumer Rights
No provision waives a consumer's substantive or procedural rights under Ontario consumer-protection legislation. An unenforceable provision will be interpreted or limited only as necessary to comply with law, and the remaining provisions continue to apply to the extent permitted.
35. Changes to These Terms
Akira Jewellery may update these Terms & Conditions. The version applicable to a transaction is the version disclosed and applicable when the agreement was entered into, subject to mandatory legal requirements. Changes after a completed transaction will not retroactively remove or reduce existing rights.
36. Severability
If a provision is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be interpreted or limited to the minimum extent necessary to comply with law.
37. Governing Law
These Terms & Conditions are governed by the laws of Ontario and the applicable laws of Canada. Nothing prevents a consumer from exercising rights or remedies under consumer-protection legislation.
38. Entire Agreement
For a particular purchase, the applicable agreement may consist of these Terms & Conditions together with the invoice, order confirmation, product description, custom-order authorization, financing agreement and other written terms expressly incorporated into the transaction. Mandatory law prevails. A transaction-specific written agreement modifies these Terms & Conditions only to the extent permitted by law.
